You Can Teach an Old Dog New Tricks…Me

shoplifting1I was recently the Keynote Speaker at a retail conference. The audience was very engaged! As a speaker and trainer I like those situations best.

We had many great questions and comments. But there is one that I continue to think about. Someone mentioned that a way that shoplifters are now discouraging you and your staff from providing customer service is by using a cell phone.

Let’s step back. The first key to preventing shoplifting is the liberal application of customer service. Impulse, armature and professional shoplifters cannot ply their evil trade if your staff is customer servicing them to death.

So now enters the cell phone. If the shoplifter is on a call, real or pretend then we are likely, out of courtesy not to approach them. What a wonderful way to keep us away from them in our own store! This is something I had never considered before. In fact what I have been thinking about is that there are other tools they could use to accomplish the same thing.

Listening to music with a head set on, talking on a two-way radio as if it is work related or how about being busy with electronic tablet or phone with email. Again any situation they can create to keep us at arm’s length.

However, there is a well-established solution to this. All of these techniques fall under the category of distraction or diversion. The solution to this tactic is simply MORE customer service.

Those actions by a “customer” are at a minimum rude. It is also a red flag that you should now pay attention to. Being in your store, taking your time and resources and being on the phone is rude. But we do not want to respond in kind. Instead apply an even more generous application of customer service.

Stay with them, keep your eye on them and make sure they know it. A legitimate customer will feel it and get off the phone, device…. The shoplifter will have a different reaction. They will get frustrated. You are frustrating their efforts to obtain a bit of privacy so they can conceal your merchandise.

Frustrating a shoplifter is our goal. Drive them crazy and send them on their way hopefully never to be seen again, at least by you!

Post Christmas Blues

theft (10)Well, the 2014 Holiday Season is over; now we are dealing with the post-Christmas issues, returns, inventory and tallying up how we did! Even without official numbers you probably have an idea. Are returns higher than what you expected? Did shoplifters get more than what you were prepared to lose? One of the problems, we as business owners face, is that we get ramped up for sales but we tend to put off preparing for loses. We tell ourselves that we will get to it later. Then when that B or C priority rises to the level of serious loss, it is too late. But we all do that, with many things. It is part of running a business.

Eventually we get tired of dealing with something over and over again and decide to break the cycle. What is the saying? “Doing the same thing over and over but expecting a different result, is the definition of insanity”. Thieves will not go away, in fact they will only get worse unless you deal with them head on with real business solutions. Shoplifting and employee theft are actually very simple issues to address. You will never eliminate them completely, however, you can reduce them to an expected level balancing the cost and effect.

Many retailers do not realize that they can and should attack both issues internally first. Take a look at your procedures. Step back and look at them – I mean truly LOOK at them, hard. Why are you doing something the way it is done? Is that the reason for your losses? A good example may be your cash handling procedures.  Is your till generally short? How much? Why? If your policy is that you do not make an issue out of a drawer that is $15 or less short, then you have sent the message to your employees that they can steal or be careless up to $15. Fifteen dollars multiplied by 365 days a year is A LOT of money to any retailer, large or small. All of this because of your “procedure” or attitude.

How about shoplifters? Do you really know how to prevent and stop them? Do you teach this to your employees? If you don’t you can never expect to be as profitable as you can and should be. Shoplifters will react to your efforts by going elsewhere. That is what you want. This allows you to spend more of your resources and human capital on your paying customers. Sell more, lose less should be your motto!

Building Partnerships

law-3Every store should have a way to build reliable partnerships with local law enforcement. For some jurisdictions, that could mean the sheriff’s department, city or county police. In some rural areas, that might even mean the state police department. There are many was to build these partnerships, and your store’s safety and security will benefit greatly from those partnerships.

What you are looking for is to have periodic visits from these law enforcement officers. Ever wonder why you see police at a donut shop? For one, the shop owners frequently give free or reduced prices on coffee to these officers. It is a nice gesture to these officers, but also an incentive to get them to frequent the shop. The more often police are in the shop chatting, drinking coffee etc, the less likely the shop is to be robbed.

Coffee and donut shops are often open late, and have only one or two people working. This makes them prime targets for robberies. Having an increased police presence helps to reduce the risk. If something were to happen, the police would quickly respond not just because that is their job, but also because they are probably on a first name basis with that shop owner and its employees. For these businesses, a cup of free coffee is a small price to pay for that kind of security and peace of mind.

Depending on the kind of store you have, giving product out for free or at a discount may not be feasible. That doesn’t mean you can’t make it worth it for local law enforcement to stop by periodically. Even though most departments shy away from case quotas, officers who do produce cases are given raises and promotions over those who don’t. By building partnerships with officers you can get some extra help with your suspected shoplifters, reduce losses, and help out your local community by giving local law enforcement tips on suspected criminal activity in your store.

Most law enforcement agencies have a community resource officer. They would be one of the first points contact to start building a relationship with. Asking if they would be willing to do a safety or security presentation for an employee meeting is a good way to break the ice. It is the first step in letting the local police know they are welcome in your store.

One of the next ways is to see if there is a retail anti theft task force set up. If so, ask if they would be interested in putting your store on their list. These task forces go into local businesses, in particular around busy holiday shopping seasons, and look for shoplifters, credit fraud, and other criminal scams. The task force will send officers into stores, generally in plainclothes, to watch cameras or do floor surveillance to spot any criminal activity.

These task forces are a free service to their retail community. While these officers are in your store, you can talk to them about what kinds of thefts you are experiencing. It also gives you an opportunity to connect with the officers and get to know who they are. These officers can become invaluable resources even after the task force is done for the season.

You now have specific officers that you can call if you have a shoplifter in your custody, or experienced a high dollar theft. The officers might be more willing to do some investigative legwork on your case, if you have built a partnership with them. Of course, part of the partnership is showing restraint and professionalism to these officers.

It is not suggested that you call them for every low dollar shortage that walk out your door, or for people who “seem suspicious” but you have no corroborating evidence. There are still laws that must be upheld regarding liable and slander. If you consistently show poor decisions about which cases to call on, you will tarnish your reputation negating any usefulness of your partnership. Remember, there is a difference between offering viable leads to confirmed inventory losses, and crying wolf over every gut feeling you have.

What Is Your Return Policy This Holiday Season?

theft (13)Many stores around the country accept returns without a receipt. Some have date restrictions, or a credit transaction look up if you do not have the receipt, but others let you exchange or return merchandise with only an id. Wal-marts’ policy time restriction is 90 days with some exceptions with electronics, otherwise you can get a cash refund for purchases under $25 dollars or store credit for purchases of over $25. Target, office Depot, Lowes, Kohl’s and other stores do not require a receipt, although they can look up the transaction with your membership or credit card transaction. Making your policy clear on purchases this holiday season can save your business money and avoid the confusion with your employees about the return policy of the store. Shoplifting suspect arrested after running out of gas during chase

Snellville police nabbed a suspected serial shoplifter earlier this week after a harrowing chase through five jurisdictions that ended when the suspect ran out of gas.

Carl Ashley Thompson, 30, of Ball Ground, was taken into custody Tuesday. He faces a slew of traffic violation charges, along with three counts of felony theft by shoplifting, fleeing or attempting to elude a police officer, criminal trespass and for possessing drug-related objects.

No one was injured during the chase, which began when an officer tried to stop Thompson around 3:40 a.m. for speeding – going 51 mph in a 35 mph zone. The officer also noticed that the car had no license plate.


Shoplifting leads to drug discovery

COOKEVILLE — A reported shoplifting led to more trouble for one Cookeville woman.

According to a police report filed by Cookeville Police Officer Kenneth Frye, it began with a reported shoplifting around 3 p.m. Friday at Kohl’s department store on Jackson. A female was reported to have left the location without paying for some items.

Dispatch gave him a description of the vehicle and the tag, which he located traveling south on South Willow Avenue. He stopped the vehicle in the area of 851 S. Willow Ave. and came into contact with the driver, identified as Fawn Price of Top Road, Cookeville.

“During a consent search of her person, I located a black “straw” with white residue,” Frye’s report states. “Price told me that she used it to ‘snort’ Hydrocodone.”


Addicts target Wal-Mart in shoplifting scheme

INDIANAPOLIS – Feeding a heroin addiction often means addicts resort to stealing – from friends, family and businesses.

For former heroin addict Ashley Milburn, it meant a shoplifting scheme involving a group of women earning hundreds of dollars a day illicitly by scamming Wal-Mart.

Milburn, now serving time behind bars, spoke to Call 6 Investigator Rafael Sanchez about how she used to steal from the big box retailer – and how she’s sure her fellow heroin users are still going about it.

The key to the scam: Wal-Mart’s no-receipt policy for returns.


Court Room Drama

law-3If you have never been in court before, it can be a very eye opening experience. There are similarities between TV courtroom proceedings and real life, but the overall experience is very different. If you are planning on prosecuting shoplifters or employees for theft, it is important to understand this step in the process.

Working within the court system is essential to ensure the employee or shoplifter has an official record of their wrongdoing. This criminal prosecution provides concrete evidence against an employee or shoplifter of their alleged acts. This record makes it easier for potential employers to understand an applicants past history, an indicator of their future reliability.

Here is how the process generally works. At the time of a shoplifter’s apprehension, or the completion of an employee theft interview, local law enforcement will be called in. This could be the city police, county police, or even the local sheriff’s department based on your individual store’s location and jurisdiction. If you have multiple locations, understand the jurisdiction might be different for each one. Specifically knowing which department to call ahead of time will simplify the process during an actual incident.

The responding law enforcement will ask a few questions from you. They will take a statement from both sides, and usually ask to see any video available. This is the initial opportunity to present your evidence against the suspect. This is not a time to hold back actual evidence you may have, or give unsubstantiated opinions as evidence.

Law enforcement will take the suspect into custody (if applicable) and file a police report. You may need to go down to their station to fill out additional paperwork depending upon the local protocol. From there papers will be filed with the court system. You should receive a subpoena stating the time, date and place of the court case for your suspect. Understand that it might take a few weeks to several months for this to happen. It is all based upon your local court’s current caseload.

During this downtime, you should ensure that you have created a case report with statements explaining each step of the shoplifting incident, any statements made by the suspect, any paper evidence, a detailed listing of merchandise stolen (size, style, UPC or SKU, color, quantity) photos taken of the suspect, their ID or the merchandise, employee ID, and any video evidence. This case report needs to be kept in a private, locked file cabinet or other place that eliminates contact or access by other employees. Any deviation may allow the defendant’s attorney to question the integrity of the chain of evidence and speculate that it has been tampered with.

When you are set to go to court on the specific time and date given, make sure you show up early and bring your case report with you. Law enforcement may have requested copies at the time of the arrest, but it is better for you to not rely on law enforcement to bring it with them. They have so many cases on a daily basis; they may not remember months later what they were given. It is your responsibility to prove the suspect guilty based upon your evidence. If you show up with nothing, the suspect may be found innocent. Bring the report and file with you.

When you show up, find the prosecuting attorney. They are the ones presenting the case on your behalf. Show them your file, your video, and answer their questions. They are not trying to pick your case apart; they just need to have a full understanding of what they can present to the defense attorney and the judge. Arriving early allows you enough time to best prepare your case with the attorney and have better end results.

While you cannot dictate that a suspect is charged with a specific crime (felony theft vs. misdemeanor theft) you are allowed to let the attorney know that the suspect is not to return to any of your store locations. If so, they will be charged with trespassing.

At this point the attorney will confer with the defense attorney. They will try to work out a plea bargain, which the suspect hopefully will take. They may not stick with the original charges, but a plea bargain will save you countless hours and trips back and forth to the courthouse for an actual trial.


Should They Stay, Or Should They Go?

shoplifting5When you or your employees apprehend a shoplifter, you will need to make one of two choices as to what to do with them. You can either recover your merchandise and let the shoplifter go about their way, or you can take the shoplifter back to an office or other neutral location within your store. Both have their advantages, and both have potentially negative outcomes if not conducted properly.

The easiest thing to do is to retrieve your merchandise from the shoplifter and let them go. No muss, no fuss, and no lengthy apprehension process to deal with. You will need to document the incident and keep the report in a secured location. You need to document the time and date, the description of the suspect, what merchandise (include item numbers or UPC codes) was taken and recovered. Any video of the incident should be retained, and a photo of the merchandise should be taken also. Notate what happened to the merchandise- is it being kept as evidence, or was it returned to the sales floor after being photographed.

Don’t underestimate that a shoplifter will try and come back and sue your store for false detention and liable. They may assume that because you did not prosecute that you did not have enough evidence, which is why you let them go. Even if they were to loose the case (because you had everything well documented) you can still fight with your store’s reputation if the media gets involved, or simply the time and money it will cost you to fight the charges.

Of course this is assuming that the shoplifter stopped and willingly handed over the stolen merchandise they were carrying. If the shoplifter runs, fights, or is problematic, it might not be easy to recover your merchandise. Similarly, if the merchandise is hidden within a bag, or on the shoplifter’s body somewhere, you cannot go searching for it to get it back- especially if the shoplifter is denying having stolen anything.

If you do bring a shoplifter back to your office, you should do so with purpose. Do you need to recover product in a bag? The shoplifter will still need to hand it over to you; you may not search their personal belongings. If the suspect has hidden merchandise on their person, you may not make them disrobe to retrieve your merchandise. That is something that absolutely should be left for law enforcement to do.

Once back in the office, your witness should be taking notes as to what is being said, and what transpires. The shoplifter’s ID should be obtained and photocopied (as proof of who was stopped). You may question the suspect to find out why they are taking product from you and what were they going to do with it later. This is particularly important if you are experiencing multiple losses of the same products. Keep in mind that they may not talk to you, and they are not required to talk to you. You may not force them or coerce them into confessions or into giving up more information.

Your company should have a set policy on who is prosecuted and who is not (also why not). Commonly, elderly, young children or minors, and mentally disabled are not prosecuted. Generally it is because these categories of people do not have the mental capacity to distinguish right from wrong. Prosecutions and referrals to law enforcement should have standardization to them. This way, employees won’t need to make a personal judgment call on who is prosecuted and who is not.

Finally, keep you back office area, or where ever you will bring shoplifters to, clean. There should not be anything large or heavy (staplers, three hole punches, scissors) that can be turned into a weapon. This area should also be relatively remote. It should not be an area where customers and other employees can walk by. The suspect has a right to their privacy during the apprehension. They should not feel like they are out on display.


Are You Letting Your Employees Steal From You?

theft (2)Employee theft is one of the most difficult issues a business owner faces. An employee is 15 times more likely than a non-employee to steal from an employer and they are responsible for approximately 44% of business’s theft losses (National Federation of Independent Business). And yet it’s one of the problems owners and managers are least likely to address.

However, the denial method of management doesn’t work causing nearly a 1/3 of businesses to fail due to employee fraud (U.S. Department of Commerce).  There are many reasons why owners are resistant to addressing the problem of employee theft. Three of these reasons are centered in the owner’s personal beliefs.

I’m a good guy – Some managers simply refuse to consider the idea that their employees would steal from them. They believe “I’m a good guy, so my people will never steal from me”. They misinterpret the issue of employee theft as a personal issue, a referendum on their character, rather than the personnel, business and legal issue that it is.

It’s not that much – Many loss prevention specialists, accountants and business analysts are aware of the open “secret” in many small businesses. Some owners and managers know and don’t care that their employees are stealing. They think, but don’t actually know, the loss is a small amount and for a variety of poorly thought out reasons believe it’s “not worth dealing with”.

There’s nothing I can do about it – These owners or managers don’t want the responsibilities of their jobs. They develop beliefs which permit them, in their minds, to not be held accountable for their managerial duties. For example, they have convinced themselves thatit’s impossible to find good quality workers, so employee theft happens all the time and everyone does it. In this rationalization, there’s nothing the manager can do, so he’s justified in doing nothing.

One of the most important components to any comprehensive loss prevention program is management’s commitment to and involvement in it. Many times business owners can be the biggest obstacle to a successful program due to their erroneous personal beliefs. Regrettably, many have found that ignoring the vital issue of employee theft leads to drastic consequences.

Trio of shoplifting suspects nabbed by Bossier Police after wild ride in Walmart parking lot

It wasn’t the getaway some shoplifting suspects were hoping for Monday in Bossier City.  Officers responded to Walmart in the 2500 block of Airline Drive in reference to three women who were seen shoplifting in the store. The suspects ran out of the store after they were confronted by store security.

While one of the suspects was attempting to get away in a car, she backed over a woman’s foot. The woman’s adult daughter confronted the driver and as the suspect attempted to drive off, the daughter jumped on the hood of the car. The suspect then sped through the parking lot with the daughter on the hood.

As police arrived on the scene the suspect slammed on the brakes and the daughter was thrown off the hood and landed on the pavement. The daughter was taken to University Health in Shreveport by BCFD with a possible broken leg. The mother who got her foot run over was checked out at the scene by BCFD and did not need to go to a hospital.


Shoplifting foiled, four arrested

Four people were jailed Saturday after a failed shoplifting attempt.

Jason R. Walker, 29, of 1612 Roanoke Ave. in Uhrichsville, and Casey L. Myers, 33, of 413 12th St. in New Philadelphia, left Sears at Belden Village Mall around 1:15 p.m. without paying for a universal charger and pair of women’s shoes, said Stark County Jail records.

Carol D. Henry, 34, who Stark County Jail records say is homeless, and Stacey J. Jones, 28, of 131 Third Drive NW in New Philadelphia, arrived with Walker and Myers and were waiting in the parking lot. Jackson Township officers were given permission to search the car and found items used to make methamphetamine in the trunk.

All four were charged with assembly or possession of chemicals for the manufacture of drugs, a third-degree felony. Walker also was charged with petty theft, and Myers was charged with complicity.


Crime and Education

law-3It is unclear according to researches whether the United States can reduce the crime rates by increasing education. The clear notion about crime- and in this case shoplifting crime- is that the United States alone loses billions a dollar every year to this very expensive social issue and a solution is still to be seen. Are All Criminals Stupid?

Sane people are thrilled that those dimwitted criminals are in prison so they can’t add to the gene pool even more.

Are all criminals stupid or are all stupid people criminals? Evidently it is true that one has to be a little stupid to choose a life of crime. The following evidence seems to substantiate that fact.

James Elliot took his .38 caliber revolver with him to carry out a robbery in Long Beach, California, and the gun failed to fire leaving his intended victim wild-eyed in fear. James then did something that will guarantee his entrance into the Stupid Criminal Hall of Fame. He looked down the barrel and pulled the trigger again! This time it worked. Jimmy is no longer with us but then he never was!

Recently a man walked into a gun shop and tried to rob it with a baseball ball bat! The owner and customer used their guns to convince him that he was deficient in his planning. Just as an intelligent person does not take a knife to a gun fight, you don’t take a ball bat to rob a gun store.

Petty Theft Loss Prevention Program Success Leads to Expanded Adoption Nationwide.

Shoplifting Prevention For Retail Stores

If you’re the owner of a local retail store, there are many things that you can do to maximize profits. One thing that every retail store faces is loss due to theft, and some business owners just write theft off as something you can’t prevent. While you certainly can’t prevent theft with absolute certainty, there are certain things that you can do minimize it and prevent major losses. One major thing that you can do to combat theft is to invest in security cameras that you can place around your store. There are many ways that cameras can help you avoid theft as much as possible.

First, cameras act as a major deterrent to those who might otherwise try to shoplift in your store. The presence of cameras can be intimidating and make it discouraging for potential shoplifters. It’s one thing for an otherwise confident person to walk into a store he or she knows isn’t monitored by cameras, but it’s an entirely different thing to know that every move made will be recorded. This forces shoplifters to be extra careful, which many of them likely won’t really consider to be worth it.

Although cameras can reduce theft, they can’t prevent it entirely. In cases where theft does take place, having high performance cameras in place can help you ensure the responsible parties are brought to justice. Having high-resolution images to sort through as you’re attempting to find culprits in cases of theft can make it much easier to do so.
